The Ministry of Foreign Affairs hosted a meeting to ensure accountability for the crime of aggression committed against Ukraine

At the invitation of Minister Jan Lipavský, legal experts from a number of EU member states, representatives of Ukraine, and other states met on Thursday, January 26th 2023, to discuss the possibilities of establishing a tribunal for the prosecution of the crime of aggression towards Ukraine.

“Today’s meeting and large turnout confirm that impunity for the crime of aggression must not be tolerated.  This is one of the initial meetings, which should, by the end, find a way to punish the current political leadership of Russia for aggression against Ukraine,” said the head of Czech diplomacy, Lipavský.  The meeting took place on the grounds of Czernin Palace and was attended by representatives from EU member states, other G7 countries, and representatives of EU institutions, which play a key role in the deliberations on the creation of a special tribunal to punish the crime of aggression committed against Ukraine.

In relation to other crimes under international law (war crimes, crimes against humanity, genocide), the International Criminal Court (ICC) may exercise jurisdiction over them. “Czechia fully supports the investigation of the situation by the ICC, which is taking place primarily in relation to war crimes. However, the ICC cannot exercise jurisdiction in relation to the crime of aggression in the given case,” informed Martin Smolek, senior director of the legal and consular section, when explaining the reason for establishing a special tribunal.
